Terms and Conditions of Service

These Terms and Conditions (the “Terms”) govern access to and use of the website tuuning.ai and services offered by TUUNING.AI S.R.L. SEMPLIFICATA (VAT IT06239530873), based in Italy (the “Company”, “we” or “our”).

By using the Service, you acknowledge that you have read, understood and fully accepted these Terms. If you do not accept the Terms, please do not use the Service.

1. Definitions

  • “Service”: the Tuuning.AI platform, including the website, the AI assistant “Speedy”, chat features, file upload, engineering mode and any related services.
  • “User”: any natural person who accesses the Service, whether with a free or paid account.
  • “User Content”: messages, files, images and any data entered by the User into the Service.
  • “AI Response”: any output generated by the Service's artificial intelligence.

2. Service Description

Tuuning.AI provides an AI-powered assistant specialized in motorsport consulting, tuning, setup, components and diagnostics for cars and motorcycles. The Service is available in a free version (with limitations) and a PRO version (paid via subscription).

3. Registration and Account

  • To use the Service, you must create an account with truthful and up-to-date information.
  • You are responsible for the confidentiality of your login credentials.
  • You are responsible for all activities carried out through your account.
  • The Company reserves the right to suspend or delete accounts that violate these Terms.

4. Subscriptions and Payments

  • PRO plans are offered on a monthly, quarterly, yearly or one-time (Lifetime) basis.
  • Payments are securely processed by Stripe, Inc. The Company does not store credit card data.
  • Subscriptions renew automatically unless cancelled before the end of the current period.
  • Refunds are handled according to applicable refund policy and the right of withdrawal under EU consumer law (Directive 2011/83/EU). Consumers may withdraw within 14 days of subscription, unless they have expressly consented to immediate execution of the digital service and waived the right of withdrawal.
  • The Company reserves the right to change prices with at least 30 days' notice.

5. AI Response Liability Limitations

IMPORTANT CLAUSE — READ CAREFULLY:

  • AI Responses are automatically generated and are informational and educational only. They do NOT constitute professional advice of any kind (engineering, mechanical, legal, financial or otherwise).
  • AI Responses may contain errors, inaccuracies or outdated information. Users must always verify information received before making any decisions.
  • The Company does not guarantee the accuracy, completeness, reliability or suitability of AI Responses for any specific purpose.
  • The Company disclaims all liability for direct, indirect, incidental, consequential or punitive damages arising from the use of or reliance on AI Responses, including but not limited to damage to vehicles, persons, property or economic losses.
  • Users use AI Responses at their own risk and agree not to hold the Company liable for any consequences arising from the practical application of information received.
  • For technical work on vehicles, users are advised to consult qualified and certified professionals.

6. Intellectual Property

  • The Service, its source code, design, logos, trademarks and all original content are the exclusive property of the Company and are protected by copyright and industrial property laws.
  • Users retain ownership of their User Content, granting the Company a limited, non-exclusive, revocable license to process such content solely for the purpose of providing the Service.
  • Reproduction, distribution, modification or commercial use of the Service or its content without written authorization is prohibited.

7. Acceptable Use and Restrictions

Users agree not to:

  • Use the Service for unlawful purposes or in violation of applicable laws.
  • Attempt unauthorized access to the Company's systems.
  • Use bots, scrapers or automated tools to extract data from the Service.
  • Share credentials with third parties or create multiple accounts.
  • Upload illegal, defamatory, offensive or rights-infringing content.
  • Attempt to circumvent free plan limits or security measures.
  • Resell or redistribute AI Responses for commercial purposes without authorization.

8. Service Availability

  • The Company endeavors to keep the Service operational but does not guarantee uninterrupted availability.
  • The Service may be temporarily suspended for maintenance, updates or force majeure.
  • The Company reserves the right to modify, suspend or discontinue the Service (or any part thereof) at any time, with reasonable notice where possible.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available”, without warranties of any kind, express or implied.
  • The Company's total liability to the User shall in no event exceed the amount actually paid by the User in the 12 months preceding the event giving rise to the claim.
  • The Company shall not be liable for data loss, service interruptions or damages arising from causes beyond its reasonable control.

10. Indemnification

Users agree to indemnify and hold harmless the Company, its directors, employees and collaborators from any claims, damages, costs or expenses (including legal fees) arising from violation of these Terms or misuse of the Service by the User.

11. Privacy

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

12. Changes to the Terms

The Company reserves the right to modify these Terms at any time. Changes will be communicated via the website and/or email. Continued use of the Service after publication of changes constitutes acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute arising from these Terms, exclusive jurisdiction shall lie with the court of the consumer User's place of residence or domicile, pursuant to the Italian Consumer Code. For non-consumer users, the court of Catania shall have exclusive jurisdiction.
