General Sale Terms

These General Sale Terms (the “Terms”) govern the purchase of subscriptions and digital services offered by TUUNING.AI S.R.L. SEMPLIFICATA (VAT IT06239530873), based in Italy (the “Seller”), through the website tuuning.ai.

By making a purchase, the User declares to have read, understood and fully accepted these Terms.

1. Subject

These Terms govern the sale of the following digital services:

  • PRO Monthly Subscription
  • PRO Quarterly Subscription
  • PRO Yearly Subscription
  • PRO Lifetime Access (one-time payment)

All services are delivered digitally through the Tuuning.AI platform and do not involve the delivery of physical goods.

2. Prices and Payment Methods

  • Prices are in Euros (€) and include VAT where applicable.
  • Payments are securely processed by Stripe, Inc. The Seller does not store or have access to Users' credit card data.
  • Accepted payment methods: credit and debit cards (Visa, Mastercard, American Express) and other methods supported by Stripe.
  • Recurring subscriptions (monthly, quarterly, yearly) renew automatically at the end of the current period, unless cancelled before renewal.
  • The Seller reserves the right to change prices with at least 30 days' notice. Changes do not apply to active subscriptions until the next renewal.

3. Service Activation

Access to PRO features is activated immediately after payment confirmation by Stripe. The User will receive an activation confirmation directly on the platform.

4. Right of Withdrawal

Under EU Directive 2011/83/EU and Italian Consumer Code (D.Lgs. 206/2005, Articles 52 et seq.), consumer Users have the right to withdraw from the contract within 14 days from the subscription date, without giving any reason and without penalty.

To exercise the right of withdrawal, the User must send an explicit communication to info@tuuning.ai indicating:

  • Full name
  • Email address associated with the account
  • Purchase date
  • Declaration of intent to withdraw from the contract

The refund will be processed within 14 days of receiving the withdrawal notice, using the same payment method used for the purchase.

5. Exceptions to the Right of Withdrawal

Under Article 16(m) of EU Directive 2011/83/EU (and Article 59(1)(o) of the Italian Consumer Code), the right of withdrawal is excluded for the supply of digital content not supplied on a tangible medium when the User has expressly consented to the immediate performance of the service and acknowledged the loss of the right of withdrawal.

During the purchase process, the User may consent to immediate service commencement. In such case, the right of withdrawal is waived.

6. Refund Procedure

  • Refund requests must be sent to info@tuuning.ai.
  • Refunds for withdrawal within 14 days are processed in full.
  • For recurring subscriptions, cancellation prevents the next renewal but does not entitle a refund for the current paid period, unless otherwise required by law.
  • Refunds are processed through Stripe and credited using the original payment method.

7. Invoicing

  • Invoices and payment receipts are automatically generated by Stripe and accessible from the “Manage Subscription” area in the user profile.
  • For business invoicing needs (VAT number, company name, electronic invoicing code), Users can update their tax details directly in the subscription management portal.

8. Warranty and Conformity

The Seller guarantees that the digital services purchased conform to the description on the website at the time of purchase. In case of non-conformity, the User is entitled to the remedies provided by the Italian Consumer Code (Articles 128 et seq.).

9. Governing Law and Jurisdiction

These Terms are governed by Italian law. For disputes arising from this contract, exclusive jurisdiction lies with the court of the consumer User's place of residence or domicile, pursuant to the Italian Consumer Code.
